HOGO Market operates markets through which you can buy African products, your fashion items, electronics, and items made by hand directly to vendors based across Canada. We want to ensure that the experience of HOGO Market is the best for you and your vendors. See this document for more information on your rights and obligations as a buyer.

This regulation is part of our terms of use. By opening an account on HOGOMarket, you agree to this settlement as well as our Terms of Use.

1. General:

1.1 These Terms govern the conditions of access to this website and the services offered (Named the "Service") and their conditions of use. By using this Service you agree to be bound by these Terms. If you do not wish to be bound by these Terms, please do not use this service, and/or do not register.
1.2 In these Terms and Conditions, the terms "HOGO Market", "we" and "our" refer to HOGO Market and its employees, directors, affiliates, successors and assigns. HOGO Market is a brand of the company HOGO Group inc., Registered in Quebec.
1.3 The terms "you", "your" and "yours" refer to any user of the website HOGO Market.
1.4 These Terms and Conditions took effect from July 14, 2018. These Terms and Conditions may be subjected to update.

1.5 Applicable law:
This agreement is governed by Canadian law and the parties submit to the exclusive jurisdiction of Canadian courts.
1.6 No waiver:
The failure of HOGO Market in the exercise or enforcement of any right or provision of these Terms does not constitute a waiver of such right or provision.
1.7 Change:
We may change these Terms and Conditions at any time without notice, except to the extent provided by law. You can check the latest version of these Terms at any time on this site. You may terminate your use of the Service if you dispute a change. If you use the Service after the effective date of a change, you are deemed to have accepted this change. You agree not to modify these Terms, and you acknowledge that any attempt to change these Terms by you will improve.
1.8 Entire Agreement:
This Agreement constitutes the entire agreement between the parties and supersedes any agreement or contract covering the subject of this contract.
1.9 Divisibility:
If any provision of these Terms should be deemed invalid by a court or a competent arbitrator, the parties nevertheless agree that the arbitrator or court should endeavor to implement the intentions reflected in the provision of the Terms, and other provisions hereof in full force.

2. Obligations
By buying on HOGO Market, you agree :
2.1 Not to access or to attempt to use it if you are under 18 years old and do not have the legal capacity to contract in the territory concerned;
2.2 To provide thruthful evidence, accurate, current and complete your identity and to update them as soon as they change;
2.3 To provide us thruthful informations during your checkout actions;
2.4 Not to provide false or misleading informations;
2.5 Not allow a third party to access your registration information;
2.6 Not to refuse to confirm any information your provide or refuse to cooperate during an investigation;
2.7 Not to use a proxy anonymizer, use a tool like a robot or a manual process to scan or monitor this platform.

3. Order:
3.1 Choose the desired products and click "Add to Cart". Once the selection is completed go to the "Shopping" tab, enter your information and click "Place Order".
The order processing will be done within 6 to 10 hours to assess the availability of your products for delivery purposes.
3.2 By making the order, you give us the authorization to place the order on your behalf to the merchant.

4. Payment :
4.1 We accept payment by credit card (MasterCard, Visa), PayPal and Interac Debit.
4.2 For security purpose, we receive you payment and then later pay the merchant when you have received your items.
4.3 We do not protect any payment done directly to the merchant which means if something bad happens we declined completely our responsabilities.
4.4 If a merchant ask you for a direct payment, please notify us as soon as possible through our "Contact Us" form or by sending an email to support@hogomarket.ca.

5. Costs and delivery times:
For all orders located on the island of Montreal (South Shore and North Shore of Montreal), delivery charges are fixed for a $7.99 value. Express delivery is $14.99. For orders over $150 before tax, shipping is free. Delivery times are 1 to 2 business days.
Express delivery is done the same day if the order is placed before noon the same day. Otherwise the next day between 9 am and 12 am if the order is made in the afternoon.
All standard deliveries are between 6pm and 9pm.

HOGO Market manage from order to delivery of the goods. However, HOGO Market can not be held responsible for any damage, delay, or damage incurred during shipment of the goods to the address indicated. It is the responsibility of the customer to provide an exact address (street number, apartment number, location of the front door) and a valid phone number in order to effectively coordinate the delivery process.
HOGO Market encouraged you to report any disrespectful and/or inappropriate behavior of our suppliers and/or vendors via our contact us form.

6. Sales tax:
The prices of our products include unnatural QST 9.975% and 5% GST. Taxes are detailed in the invoice we send you.
Prices subject to change without any notice.

7. Return policy :
Items purchased on the website can be returned within 10 days of receipt for an exchange or refund with the original invoice. Please note that return of goods paid for by credit card, a 5% service charge will be deducted from the refund amount. The client shall bear the costs to return the item. Shipping fees are not refundable.
Used items can not be returned. Items on special and natural products (food) are final sale.

8. Termination
Each party may terminate these terms and conditions by written notification prior to a date.
We may terminate these terms if we discover that :
you violate any provision of these terms;
you use the platform deleteriously for other customers or we believe you are committing an act capable of discrediting HOGO Market;
you are attempting to violate the security of the platform (even attempting to use unauthorized identifiers).

9. Responsibility and content buyers:
HOGO Market makes every effort to ensure the accuracy and updating of the information published on the Site. HOGO Market reserves the right to correct at any time and without notice the content of the Site. However, HOGO Market can not guarantee the accuracy, precision, updating or completeness of the information made available on the Site.
Comments, Reviews, ratings, suggestions, ideas, recipes, graphics, photos or other information provided to HOGO Market through the Blog, Reviews and social media such as Facebook are confidential. By posting content on our media, you grant HOGO Market a perpetual license and right, irrevocable, royalty-free and transferable license to use, copy, modify, delete in its entirety or in part, adapt , publish, translate, sell and distribute such content and to create derivative works or to incorporate it in any form, media or technology throughout the world without compensation to you and without mentioning the source .
The user agrees to be responsible for all content published on the Site and on social networks. This means that the user, not HOGO Market, is fully responsible for the content it publishes, including appropriateness, legality, originality, reliability and copyright relating thereto.
We may reject or remove the contents of a user without notice. However, we are under no obligation to monitor the User Content and you agree that we are not responsible for the User Content, or for any loss and any damage resulting.

10. Complaints:
To make a claim on the Market HOGO service, please send an email to the address on the 'Contact Us' or by e-mail to support@hogomarket.ca.
We will acknowledge your complaint within two working days. We will conduct investigations and present the results of our investigation within seven working days from the date of receipt of your claim.

11. Security :
We takes security very seriously.
We do our best to use advanced technologies to ensure the security of your information and transactions.
HOGO Market service is a safe and convenient place to buy and sell.
If you know a person or entity that uses the inappropriately service, please let us know.
Similarly, if you receive an email supposedly come from us, first check the last part of the sender, it should end with "@ hogomarket.com" but if you suspect a phishing scam, please and transfer or send using this email using the contact form or by email (support@hogomarket.ca).
